Child custody refers to the legal rights and responsibilities that a parent or guardian has regarding the care, control, and upbringing of their child. When parents separate or divorce, child custody arrangements determine how these responsibilities are divided. Determining child custody can be a daunting task. There are many things to consider, and the courts want to ensure the best possible outcome for the children.
There are four types of child custody in Ontario:
Temporary Custody Order
A temporary custody order is exactly as it sounds… temporary. When custody hearings are ongoing, a temporary decision is made as to where the child(ren) will live.
Sole Custody Order
A sole custody order is when one parent gets exclusive decision-making authority over the well-being of the child/children.
Joint Custody Order
A joint custody order is when both parents are given equal decision-making rights over the well-being of the child/children.
Shared Custody Order
When parents share time with their child, it doesn’t change who gets to make the important decisions. Instead, it affects child support. If you share custody with your ex-spouse, it won’t change the main parent’s power to make final decisions. If the child spends at least 40% of the time with the other parent, that parent might have to pay less child support.
